Tier 2 General Migrant visa


You can apply for a Tier 2 (General) Migrant visa to come to the UK as points based system skilled worker if you have been offered a skilled job that cannot be filled by a UK settled worker.
You can apply as a Tier 2 points based migrant either from overseas or switching from the UK if your current visa category allows you to switch.
If you are applying for entry clearance from overseas you will need a “restricted” Certificates of Sponsorship from your employer.
There is a general limit on annual” restricted” Certificates of Sponsorship issued each year to employers to assign to workers. The employer will need permission from the Home Office before a certificate is assign to a migrant worker.
If you apply to switch into Tier 2 (General) from within the UK your employer will assign you with an “unrestricted” Certificate of Sponsorship. The Sponsor does not usually require permission from the Home Office to assign you a certificate as a migrant worker.

➢   What are the requirements of Tier 2 (General) migrant Visa?

To be eligible you will need to demonstrate that you can score 70 points as follows:-
• 30 points Certificate of Sponsorship (CoS)

You will be eligible for 30 points if you are issued with a certificate of sponsorship (CoS) from an employer that is a licensed sponsor in the UK and you demonstrate that;
• the employer has completed a resident labour market test and the job is offered first to a settled worker; or
• you are paid at or above £155,300 or more per annum; or
• the position is on the shortage occupation list
• 20 points Salary

You will be eligible for 20 points if are paid the appropriate salary for the job, the following migrants are exempt from the appropriate salary requirement;
• you were issued with the Tier 2 General visa under the rules in force before 6th April 2011;
• you are a Jewish agency employee;
• you are a member of the ground staff for a foreign airline;
• you are a minister of religion, a member of a religious order or a missionary;
• you are currently working for an overseas newspaper, news agency or broadcaster;

You must demonstrate the requisite skill level in order to qualify at NVQ Level 6 or above as indicated in the codes of practice (this is not applicable to Sports People or Ministers of Religion)
However if you are in the UK as a work permit holder the job does not need to meet NVQ Level 6, you may apply for further leave to remain at NVQ Level 4, if that was the initial skill qualifications appropriate for the job.
• 10 points English language Requirement

To be eligible for a Tier 2 visa you must meet the English Language Requirement by either;
• taking an approved English language test to level B1 of the Common European Frame of Reference (CEFR) ; or
• coming from a majority English-speaking country; or
• having a UK university degree taught in English or equivalent approved by Naric; or
• you have met the English language requirements when given a previous grant of leave as a Tier 2 migrant or work permit holder; or
• you qualify under the transitional arrangements.
• 10 points Maintenance Requirement

You must score 10 points for maintenance by showing you have at least £945 held in your bank account for a period no less than 3 months before the date of your application or;
You can also meet the maintenance requirement if your employer is an A rated sponsor and agrees to provide you with sponsorship for maintenance.

➢   Tier 2 General Extension

The Tier 2 General visa is initially granted for 3 year and 1 month. Providing you continue to meet with the initial criteria above you are able to apply for an extension for a further two years and thereafter apply for Indefinite Leave to Remain.
The Tier 2 (General) migrant visa can be extended up to 6 years. You will not be able to extend your visa after this period and will need to return to the UK under Tier 2 after 12 months cooling off period after your Tier 2 expired.
If you lose your job or become redundant as a Tier 2 migrant you will have 60 days from the date you left work to find another employer and apply for an extension of stay as a Tier 2 migrant with different employer who has relevant a sponsorship licence, otherwise any longer than 60 days will count as a break in lawful and continuous residence.

➢   Tier 2 (General) Dependants

You can bring your family dependants to the UK as point based dependants during the initial visa application or after you have been granted your visa.
Your family members are permitted to take up employment and/or study at a state or private educational establishment during their stay in the United Kingdom.

➢   Indefinite leave to remain Tier 2 (General)


You will be eligible to apply for indefinite leave to remain after 5 years continuous and lawful residence as a Tier 2 (General) migrant worker.
You will need to continue the condition of the Tier 2 (General) migrant scheme as described above.
You are allowed a period no more than 180 days absences for each successive year during your stay as a Tier 2 (General) migrant.
From 06 April 2016 to be eligible for indefinite leave to remain as a Tier 2 (General) migrant you will need to show that your annual gross salary is at least £35,000.00 or above to apply for settlement

➢   English language requirement

You will need to demonstrate that you passed a recognized English language test for A speaking and listening qualification at level B1 or above from the Secure English Language Test (SELT) list; or
An have academic qualification deemed by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the United Kingdom or
You are a national of a majority English speaking country which is recognized under the Home Office list.

➢  Knowledge of language and life in the UK

You will have to pass the Knowledge of language and life in the UK test requirement.

➢   Switching to a Tier 2 (General) migrant

You can switch to Tier 2 (General) migrant if you already in the UK under the following categories;
• Any Tier 1 main applicant;
• Tier 2 (General);
• Tier 2 (Intra-Company Transfer Established Staff) if you are applying to change sponsor;
• Tier 2 (Intra-Company Transfer), under the rules in place before 6 April 2010 if you are applying to change sponsor;
• Tier 2 (Sportsperson);
• Tier 2 (Minister of Religion);
• Tier 4 student;
• Tier 5 (Temporary Worker) in the Creative and Sporting sub-category, for a job as a professional footballer switching into Tier 2 (Sportsperson) only;
• Dependent partner of a Tier 4 student;
• Highly Skilled Migrant Programme;
• Innovator;
• Fresh Talent: Working in Scotland Scheme;
• International Graduates Scheme (or its predecessor the Science and Engineering Graduate Scheme);
• Business and Commercial work permits (except multiple entry work permits) including Intra-Company Transfer work permits;
• Sports and Entertainment work permits (except multiple entry work permits);
• Member of the Operational Ground Staff of an Overseas-owned Airline;
• Minister of Religion, Missionary or Member of a Religious Order;
• Overseas Qualified Nurse or Midwife;

Tier 2 Intra Company Transfer visa

If you are a staff of an existing company outside the UK, you can apply for a Tier 2 Intra-Company Transfer visa to come to the UK if your existing employer agrees to transfer you to a UK branch for purposes training or fill a vacancy that cannot be filled by a settled worker either on a long term or short visits basis.
You will need to demonstrate that existing company outside the UK and branch in the UK is linked by common ownership or control to the UK branch. The UK branch must have a Sponsorship licence and issue you with a certificate of sponsorship before you can apply for the Tier 2 ICT visa.

➢   Conditions of Tier 2 ICT Visa

Long Term Staff
    - have been working for existing employer for 12 months;
    - transferred to a skilled job in the UK to fill a post which cannot be filled by a settled worker;
    - have graduate level qualifications to NVQ Level 6;
    - can apply for a maximum of 5 years or 9 years if you are earning; £155,300 a year or above;
    - can also apply for a visa for less than 1 year stay.
Short Term Staff
    - have been working for existing employer for 12 months;
    - transferred to a skilled job in the UK to fill a post which cannot be filled by a settled worker;
    - have graduate level qualifications to NVQ Level 6;
    - can apply for a visa for a maximum of 12 months.
Graduate Trainee
    - be a recent graduate recruit being transferred to a UK branch for training;
    - applying under structured graduate training programme with clearly defined progression; towards a managerial or specialist role within your organisation;
    - have graduate level qualifications;
    - can apply for a visa for a maximum period of 12 months.
Skills Transfer
    - not required to have been employed for a minimum period to qualify for the visa
    - have graduate level qualifications to NVQ Level 6;
    - coming from a graduate occupation to acquire the skills and knowledge needed to perform your role overseas, or to impart your specialist skills to the UK workforce for a maximum period of 6 months.

➢   What are the requirements of Tier 2 Intra Company Transfer Visa?

To be eligible you will need to demonstrate that you can score 50 points as follows;
• 30 points if you are issued with a valid certificate of sponsorship (CoS) from an employer that is a licensed sponsor and;
• 20 points for being paid the appropriate salary
• Salary requirement for ICT Long Term Staff £41,500 and above and paid at least the appropriate rate
• ICT Short Term Staff, Graduate Trainee or Skills Transfer £24,800 and above and paid at least the appropriate rate
• The job must be at NQF level 6
• You do not need to meet the residence labour market test


➢   10 points English language Requirement

To be eligible for a Tier 2 visa you do not need to meet the English Language Requirement, however if you are if you are applying from inside the UK for an extension of the stay to over 3 years) you will need to meet the English Language requirement to the level A1 of the CEFR

➢  10 points Maintenance Requirement

You must score 10 points for maintenance by showing you have at least £945 held in your bank account for a period no less than 3 months before the date of your application.
You can also meet the maintenance requirement if your employer is an A rated sponsor and agree to provide you with sponsorship for maintenance.

➢  ICT 2 (General) Dependants

You can bring your family dependants to the UK as point based dependants during the initial visa application or after you have been granted your visa.
Your family members are permitted to take employment and/or study at a state or private educational establishment during their stay in the United Kingdom.

➢  Indefinite leave to remain Tier 2 Intra Company Transfer

You will be eligible to apply for settlement (Indefinite Leave to Remain) after spending a continuous 5-years stay as a Tier 2 ICT migrant.
You are allowed a period no more than 180 days absences for each successive year during your stay as a Tier 2 (General) migrant.

You will need to demonstrate that you passed a recognized English language test for A speaking and listening qualification at level B1 or above from the Secure English Language Test (SELT) list; or
An have academic qualification deemed by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the United Kingdom or

• that the role you will be doing involves living mainly within and being a member of a religious order, which is a lineage of communities or of people who live in some way set apart from society in accordance with their specific religious devotion, for example, an order of nuns or monks.
• You must be able to meet the genuineness test if you are interviewed
• 20 points Salary

You will be eligible for 20 points if are paid the appropriate salary for the job where your employer must confirm financial support in funds and/or accommodation throughout the period of employment and that you will receive pay and conditions at least equal to, or excess of those normally given to a settled worker in the same role.
• 10 points English language Requirement

To be eligible for a Tier 2 (Minister of Religion) you must meet the English Language Requirement by either;
• Taking an approved English language test to level B2 of the Common European Frame of Reference (CEFR) in reading, writing, speaking and listening; or
• coming from a majority English-speaking country;

You can work for up to 20 hours a week in a second job which is not listed under the shortage of occupation list.
You cannot own more than 10% of your employer’s shares (unless you earn more than £155,300 a year.

➢   Tier 2 (Minister of Religion) Dependants

You can bring your family dependants to the UK as point based dependants during the initial visa application or after you have been granted your visa.
Your family members are permitted to take employment and/or study at a state or private educational establishment during their stay in the United Kingdom.

➢   Indefinite leave to remain Tier 2 (Minister of Religion)

You will be eligible to apply for indefinite leave to remain after 5 years continuous and lawful residence as a Tier 2 Minister of Religion.
You will need to continue the condition of the Tier 2 (Minister of Religion) scheme as described above.
You are allowed a period no more than 180 days absences for each successive year during your stay as a Tier 2 Minister of Religion.
You must still be required by your current Sponsor in the role recorded on your Certificate of Sponsorship for the foreseeable future.
There is no requirement for to earn the appropriate rate for the job as stated in the Codes of Practice in Appendix J.

➢   English language requirement

You will need to demonstrate that you passed a recognized English language test for A speaking and listening qualification at level B1 or above from the Secure English Language Test (SELT) list; or
An have academic qualification deemed by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the United Kingdom or

Ancestry visa


You can apply for a UK Ancestry visa to come and work in the UK if one of your grandparents was born in the UK and you are a commonwealth citizen who is applying to come from outside the UK.
To be eligible you will need to satisfy as follows:
• you are 17 or over;
• have sufficient funds to support yourself and dependants without recourse to public funds;
• are able to work and planning to come to the UK to work.


➢   Your UK Ancestor (Grandparents)

You will need to show that one of your grandparents was born in the UK including Channel Island and the Isle of Man, before 31 March 1922 in what is now the Republic of Ireland on a British-registered ship or aircraft. You can claim ancestry if either you or the relevant parent:
• were adopted;
• were born within or outside marriage in the UK;
• You can’t claim UK ancestry through step-parents.

If you are experiencing difficulties to find your grandparent’s birth certificates or parent’s marriage certificate, we can help you obtain these documents if you don’t’ have them. Maintenance
You must be able to demonstrate that you have sufficient funds for living expense and to accommodate yourself and any dependants.
You will need to have approximately £1600 held in your bank account for 3 months to show you have sufficient funds to meet your maintenance. You may use fund from someone close to you who is willing to Sponsor you and provide a sponsorship letter of support. Working
To apply for the visa you have to be able to work and intend to work , however, if you don’t yet have job you can provide evidence to support the fact that you are looking for a job, such as with a job agency. You can study in full time education whilst you are also working.

➢   UK Ancestry Visa Extension

Your dependant family members, spouse or child can apply to come as your dependants.
You can apply to extend your stay until you become eligible for indefinite leave to remain.

➢   Indefinite leave to remain UK Ancestry visa

You will be eligible to apply for indefinite leave to remain after 5 years stay under the UK Ancestry visa.

➢   English language requirement

You will need to demonstrate that you passed a recognized English language test for a speaking and listening qualification at level B1 or above from the Secure English Language Test (SELT) list; or
An have academic qualification deemed by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the United Kingdom or You are a national of a majority English speaking country which is recognized under the Home Office list.

➢  Knowledge of language and life in the UK

You will have to pass the Knowledge of language and life in the UK test requirement.

➢  Switching to UK Ancestry visa

You cannot switch into UK Ancestry visa and must apply to come into the UK from overseas.
